About the Company

Late Sh. Lalit Prasad Prabhakar being my beloved father was a renowned and well known faces among lawyers in Delhi High Court at New Delhi (India). The expertise of this man in his field can be gauzed by a simple fact that many a times he would take away cases filed by his opponents towards their end by mere raising questions on their maintainability on their first date of hearing itself before the court of law. The knowledge of this man was not restricted towards one field but towards every field connected with law be it murder references, where the accused were awarded life imprisonment by the Trial Courts situated in Tis Hazari, Patiala House, Kadkadoma or Rohini, Delhi, India or even the cases where the poor workmen were retrenched or dismissed by their employers on some petty grounds or even the cases where immediate merger or acquisitions were required by the companies etc. The goodwill of my father was more shared by both of us i.e. me and my mother, when we would go along with him in family get together, lunches or dinners hosted by their clients in honour of my father, where we both get to know the type of work my father did or doing for protecting the interest of their clients. On 21.6.2001, after having attended one such dinner hosted by one of the client of my father, we came back to our home and slept except him, who was feeling a bit uneasiness while coming home back, which he never told to us. Finally at around 3 AM he got up from the bed and start walking on the room without asking my mother about his problem in the impression that this would cause her unnecessarily worries and tension.

After a while after having heard commotion in the room my mother also woke up and become surprised to see as to why my father was walking in the room in the middle of the night? At the first instance my mother thought that he might be worried for some court case listed on the next day but after seeing him sweating and complaining of pain in the chest, she got scared and rushed to my room adjacent to hers to catch hold of me to arrange immediate medical assistance. Unfortunately by the time we both arrived in a room after having brief discussion lasted for a mere second about the health of my father, we both remained stunned after seeing that my father was lying on the bed flat with his mouth and eyes wide open. Finding no other way, we both being alone in the house tried to lift him but we couldn’t do it despite our repeated attempts as all of sudden my father had become very heavy. Finding no other alternative my mother ran towards the neighbors and banged their doors hard with all her energy to provide her all timely assistance to lift my father to the car parked on the ground floor. Within seconds all our neighbors arrived and lifted my father collectively and made him lie down at the rear seat of the car. In this page I would like to thank all those persons being part of our neighbor’s who contributed their bit in saving the life of my late father. With great efforts of all our neighbors he was finally lied down in the car after having been lifted up from the first floor of our house to the ground floor where our car was parked and was taken to the nearby hospital. Unfortunately despite best efforts of the Doctors present in the hospital life of my father could not be saved. I still remember it was around 4 AM in the morning when people had come out of their homes for morning walks and starring at me as to why I am crying horse at the corner of the road? At that moment only one question was popping up in my mind as to why god has been unkind to me more especially when I about to lend my shoulder to him in his work.

After the death of my father everything came to a halt both at his office and in his home due to my being a novice in the profession and who having spent only 3 years in the profession all of sudden given 3000 files to handle. Not only this, I was even asked for the court files by the same clients who never tired of talking in praise of my father one after another in his life time. At the first instance I could not believe that these are really those people who bend on their knees before my father to provide them his legal expertise in the court of law but after persistence and regular advice of my mother regarding their stakes in litigation, I understood things slowly. Besides all those clients there even came a major decrease in the list of our relatives and friends probably on a reason that we might not ask their assistance on some point of time after my father. I still remember the days when I would leave for the court without having any penny in pocket and for a mere hundred rupee note for daily expanse I was made to hear many things from the people around me. Not only this, there were instances wherein I have been named a duffer, who can’t earn his living by non other then my own dear ones.

I still remember instances where I found myself stuck in some typical stages of the cases in court of law having no one around to assist or to guide me. Still with the assistance of the fellow Advocates and my sheer determination to learn I tried to cope up things slowly but couldn’t as I lacked confidence due to my age and experience. There were instances when I felt to end up my life as I feel there is no hope of my being an Advocate but with the constant advice of my clerks and dear ones to wait for the right time i stuck to the profession with the hope that sooner or later things will change around me with my sheer hard work and zeal to excel in my profession. I still remember that for months I couldn’t pay the salaries of my office staff but I am thankful to all of them who didn’t run away from me and kept on managing things of their own without complaining anything. At this moment it would be appropriate to even name my bookseller, who kept on supplying me the books without asking anything in return despite the fact that his bill for the books kept on piling months after months. There was a time when it crossed one lakh rupees. Today at this stage, I would like to pay a sincere thanks to all these people without whom I would have been no where in my profession. With the blessing and help of all these people I some how managed things of my own for about year or so. Luckily in the year 2003, I got two murder cases where the accused were awarded life imprisonment by the lower courts for which appeal had to be filed before the Hon'ble Delhi High Court against their conviction. Surprising in one of two cases, the first one relates to a women who was charged with the murder of her own husband and in the second one murder took place in the area called Gole, Market,
Delhi,      India     during      the        time       of       Holy   festival.

On the first day of hearing in the very first case as the case came up for admission before the Hon'ble Division Bench, Delhi High Court, India but before I could stand up and say a single word, the Judges pronounced “No merit in appeal, dismissed”. The following order created ruckus in my mind as that was my first big case and even a stepping stone towards success, I jumped over the dice and started arguing my matter despite the fact that files of the matter had already been thrown away by the judges at the corner of their table and who even asked the court master to call out the next matter. As the situation was do or die for me I paid deaf ear to the other counsel who pressurized me to give him the way to plead his case before the respected bench. After 15 minutes of continues argument, I finally made one respected judge out of the two convinced that there was merits in my appeal and there were errors apparent on the judgment pronounced by the lower court. After realizing my initial success in making judges convinced, I became more vocal before the bench, wherein I have been asked to reply numerous questions by the judges related to the case in question, which all were replied to the best of my knowledge to the satisfaction of the judges. After listening everything from my end, the respectable judges asked the public prosecutor as to what objections he had in letting the convicts out on bail. The public prosecutor tried his best to dissuade judges that there was no appeal in the case and further appealed that it should be dismissed out rightly. After taking note of the submissions made by the public prosecutor, the judges paused a while and finally remarked appeal admitted and the accused is being released on bail for furnishing certain formalities before the Trial Court below. As I listened this I couldn’t believe for several minutes that it was me who argued the matter and who got the accused out of the jail on such heinous charges. After coming out of the court room, same people who were doubtful about my capabilities embraced me and fall on my feet, which I could not believe for several minutes as I was like god to them. The whole night I couldn’t sleep properly and wished to have my father around to share the moments of happiness. The happiness which I got from the case gave me inner happiness and courage to face any situation even in real life. Since that day there remained no dearth of work for me. Today the same man who dared to stand while uttering a single word in the court of law stands alone in front of battery of lawyers who appear against him in many of the cases. Today Rakesh Prabhakar & Com. apart from being retained by the some of the major companies for legal work is also actively involved for the betterment of the children suffering from anorectal disorders since birth through an NGO called caremycolostomy, which is having support from world over. To support this cause, I have himself filed one writ petition in the Delhi High Court wherein I tried to persuade the Centre / and State Government of India to come out in support of these children being no less then a healthy babies. Union of India and Or’s bearing WP (C) No – 5588/2007.
